The Tennessee Secretary of State explains that online notarization is a notarial act performed by means of two-way video and audio conference technology. In practical terms, that means the notary and signer are not in the same physical place, but still interact live through approved technology.
Tennessee distinguishes between the two. In e-notarization, digital signatures are used, but the signer still appears in the physical presence of the notary. In remote notarization, the signer is not physically present and instead appears through audio and video technology.
Tennessee Secretary of State guidance states that a fee can be required not to exceed $25 for each online notarization under Tennessee Rule 1360-07-03-.03.
